| [You must be registered and logged in to see this link.]The younger brother of Parkland shooter Nikolas Cruz is back behind bars Tuesday after violating his probation following a trespassing arrest at Marjory Stoneman Douglas High School. Zachary Cruz, 18, was booked into the Palm County Detention Center just before 7 p.m. on a warrant for his arrest, jail records show. Palm Beach County Sheriff’s Office deputies made the arrest. The Sun-Sentinel reports Cruz violated his probation by driving within 25 feet of a Park Vista Community High School parking lot in Lake Worth, about 26 miles north of the where the Valentine’s Day massacre happened. Cruz did not have a valid driver’s license, according to the paper. He was ordered to stay away from the Parkland school and all other schools after a March 19 arrest. Last week, Cruz attended his brother’s hearing in Broward County Circuit Court where the alleged mass shooter waived his right to a speedy trial. Will this kid ever f*cking learn?! |

He is being held without bond in West Palm Beach's Main Detention Center. Court records show a warrant was issued on Tuesday for the arrest of Zachary Cruz. The warrant was issued because Zachary Cruz violated his probation by driving on April 28 without a valid driver license and for going within 25 feet of a parking lot at Lake Worth's Park Vista Community High School. "Client did violate his probation on 4/28/2018 by Operating a Motor Vehicle Without a Valid Driver's License, to wit: a brown Kia SUV," the warrant reads. I wonder if he will serve any time for this or just get put on a more restrictive probation? |

Kimok said in an email Wednesday he has not yet been appointed to represent Cruz on the probation violation but he said he is “very concerned” about the Broward Sheriff’s Office’s conduct in this arrest. First, he said it is “very unusual” for a probation violation to be filed for driving without a license. He also said Cruz is not banned from being near a school other than Stoneman Douglas. “We all drive past and walk past schools every day and many public parks are located near schools so I’m concerned if, as it appears, BSO has violated him simply for going near a school. That just wasn’t a condition we agreed to as part of his plea,” Kimok said. Sheriff’s spokeswoman Veda Coleman-Wright said Cruz’s caretaker reported him because he was driving without a license and insurance. She said violating any law is a violation of probation. Also Wednesday, a nonprofit civil rights organization called Nexus Derechos Humanos said it is planning to file a federal lawsuit on Zachary Cruz’s behalf challenging how he has been treated by law enforcement. The group claimed in an email news release that Zachary Cruz’s rights are being violated and he has been subjected to “intimidation” solely because of the identity of his brother. It appears that Roxanne Deschamps, the woman who took in Nik and Zach after their mom died, AND who still has a hand in controlling their inheritance, turned in Zach for his probation violations. Which ended in his arrest this week. I am sure she will say that she did it for Zach's own good, but I just can't get past the shady aspect of this woman. I will add that Zachary Cruz needs to stop breaking the f*ucking law, THEN maybe he will stop being subjected to the so called "intimidation" from police. |

Sheriff Israel, speaking at a national day of prayer service at his agency’s headquarters Thursday morning, said he had not seen a lawsuit and declined to comment on the jail’s treatment of Cruz. He has indicated several times he has no intention of resigning. The lawsuit names the captain who oversees the Broward Main Jail for the sheriff’s office, the prosecutor assigned to the case, and Broward County Judge Kim Theresa Mollica, who set a $500,000 bond for Cruz in March, when Cruz was charged with trespassing, a misdemeanor with a maximum 60-day jail sentence. Donovan also accused deputies at main jail of “torturing” Cruz, using “sleep-deprivation tactics we wouldn’t tolerate on the battlefield.” Cruz was arrested again this week, accused of violating the terms of his probation. He was first arrested in March, accused of trespassing at Marjory Stoneman Douglas High School. Weeks earlier, his brother, Nikolas Cruz, killed 17 people and injured 17 more at the Parkland school. Zachary Cruz entered a no contest plea to resolve the charge. The lawsuit seeks to have Cruz’s plea deal set aside. “The treatment he received [in jail] was coercive,” said Dallas LePierre, an attorney with Nexus Derechos Humanos, a group of pro bono attorneys. “That makes the contract — and the plea deal was a contract — unconscionable in its terms.” Cruz walked into a Broward courtroom Thursday afternoon to face a probation violation hearing. Broward County Judge Melinda Brown agreed to release him under the terms of a new agreement barring him from driving without a valid license. Attorney Mark S. Lowry argued in court papers filed Wednesday that Zachary Cruz did not violate the conditions of his probation, and prosecutors apparently agreed. Lowry argued that Cruz was near a school in Palm Beach County last Saturday, but his presence there was not a violation of the terms of his probation. “One condition of Mr. Cruz’s probation was that he not be present at any school unless enrolled there,” Lowry wrote. “Mr. Cruz was not ordered to stay away from all roads that intersect, touch or otherwise come near a school’s property.” Prosecutor Sarahnell Murphy told Brown that Cruz was spotted near the entrance to a skate park that happened to be near a school and said there wasn’t enough evidence to establish that he violated probation on that allegation. His guardian, Rocxanne Deschamps, had called the Broward Sheriff’s Office over the weekend, concerned that he was driving without a license or insurance. That information was enough to convince Brown to sign an arrest warrant Monday accusing Cruz of violating his probation. So he didn't get much sleep while in jail. I'd hardly call that real torture. Although I have been an insomniac since I was little, so I really have no clue what happens when someone who is used to a normal sleep pattern would be after not getting as much sleep as they are used to. |

He will be released on supervised probation for another five months, after getting credit for time served. The suit targets Judge Kim Theresa Mollica, State Attorney Michael Satz and Assistant State Attorney Sarahnell Murphy and Broward County Sheriff's Capt. Sherea Green, a member of the jail's executive staff. CNN has reached out to the defendants for comment. The state attorney's office said, "No comment," and the sheriff's office said it wouldn't comment on ongoing litigation. Cruz requests a jury trial and seeks punitive damages and expenses, the lawsuit said. The suit alleges Mollica issued an exorbitant $500,000 bail for Cruz based on his older brother's crimes, while jail officials intimidated and harassed Cruz, deprived him of sleep and forced him to wear a restraint vest around the clock. | Well to be honest little Zachary has some apparent issues with obeying the law. His record is quite long. He was caught driving without a license or insurance while on probation. SO in my opinion he is bringing all this shit on himself by doing things he knows is wrong and against the law. Also if he was so "tortured" while he was in jail, then why does this dumb-ass keep doing additional things that he knows will likely get him arrested again? It's not like they will treat him any better the second time around. While I do agree that when he was first arrested the $500.000 bond was extreme and so was having him Baker Acted AGAIN. BUT as I said he keeps putting himself in these situations. I keep seeing a replay of that old ass Jim Carry movie Liar, Liar in my head, where he screams "STOP BREAKING THE LAW ASSHOLE!" |
