[You must be registered and logged in to see this link.]Frustrated by a Lantana-area woman who took in brothers Zachary and Nikolas Cruz after their mother’s death, a Boca Raton-based attorney dropped the brothers’ probate case , citing Rocxanne Deschamps’ interference.
Audra Simovitch said she believes Deschamps has Lynda Cruz’s furniture, an engagement ring worth about $5,000 and other jewelry, Lalique elephant crystal figurines, a grand piano, a Louis Vuitton wallet, Cruz’s credit cards and debit cards and personal identification, bank statements and other financial and medical documents and her 2015 Kia.
She also said she was “road blocked” by Deschamps in her attempts to probate Cruz’s estate, and told a judge Deschamps should appear in court and show why she shouldn’t be held in contempt.
Judge Charles Greene denied Simovitch’s motion, citing legal insufficiency.
But no one has addressed whether Simovitch’s claims of Deschamps, Lynda Cruz’s former good friend and neighbor, are true. Deschamps, 42, said the day before Lynda Cruz died from pneumonia last year she verbally asked her to take care of her sons, which Deschamps did starting Nov. 1, the day Cruz died.
The attorney said she believes Lynda Cruz’s will does exist — while there have been claims it doesn’t — along with revocable and irrevocable trusts for the Cruz brothers. Also, Simovitch said she believes there are proceeds intended for the brothers from an insurance policy and money from an annuity.
“Most concerning to the undersigned counsel, is Rocxanne Deschamps continued attempts to interfere with counsel’s ability to probate this estate and determine what assets are in existence, which assets are in Rocxanne Deschamps care, custody and control (at any time since descendent’s death) and the location of documentation that would lead to the discovery of the assets,” Simovitch wrote March 11.
Deschamps has repeatedly declined to comment, and at a news conference last week with Attorney Gloria Allred , would not address Lynda Cruz’s estate — or what Simovitch claims is in it. Instead, in a prepared statement, Deschamps said she did everything she could to warn law enforcement about Nikolas Cruz’s violent tendencies and need for guns.
The Cruz brothers have since fired Simovitch and Simovitch has also withdrawn from the case, according to court documents. Simovitch told the court hiring a new attorney for Zachary Cruz — Jose Lorenzo Jr. out of Miami Gardens — “appears to be the ‘icing on the cake’ to ensure that neither Nikolas Cruz or Zachary Cruz benefit from their deceased’s mothers estate,” according to her March 11 filing.
Then, citing red flags, Simovitch told the judge an independent, “capable” person should be appointed instead. Simovitch told the court “allegations have been made that Deschamps may not have the best interests of the estate at heart…”
So even the lawyer Nik had hired even thinks that Rocxanne Deschamps is shady. Why would this woman be hindering the legal process UNLESS she is trying to somehow gain complete control over the estate?
