I gotta wonder why they decided not to prosecute him.
It says in the article that they couldn't get in contact with the victim after the initial report. If I'm reading it correctly, it also says that for some reason, Kelley's ex-wife spoke with the victim after the assault and told her about the ongoing abuse in their marriage but even if that isn't true, my guess is that the victim was afraid of him and the possibility of retaliation if she had gone through with pressing charges. I'm not sure if the police department could have pursued the case without her testimony but I wouldn't blame her for trying to get away from the situation as quickly as possible since we know how volatile and violent he was.

If Devin had survived, he would have almost certainly got the death penalty because it's Texas.
